Expliquer de quelle mani\u00e8re elle a transform\u00e9 l&#039;exigence de la notification des donn\u00e9es \u00e0 caract\u00e8re personnel, le droit, l&#039;exception \u00e0 la suite de la D\u00e9cision du pr\u00e9sident de l&#039;autorit\u00e9 de protection des donn\u00e9es n&#039;. 200 \/ 2015.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Qui est encore sous l&#039;obligation de notifier \u00e0 l&#039;autorit\u00e9 de surveillance en 2016?<\/h4>\n\n\n\n<p>Conform\u00e9ment \u00e0 la loi indiqu\u00e9e, pour une entit\u00e9, telle qu&#039;une soci\u00e9t\u00e9, d&#039;ONG, d&#039;institutions publiques, de travailleur ind\u00e9pendant, organisation, gouvernement, etc., qui collecte et de pistes pour le traitement des donn\u00e9es personnelles de ceux qui sont d\u00e9taill\u00e9es ci-dessous, a l&#039;obligation d&#039;aviser l&#039;autorit\u00e9 de protection des donn\u00e9es.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">1. Le traitement des donn\u00e9es personnelles et des donn\u00e9es personnelles relatives \u00e0 votre origine raciale ou ethnique, les opinions politiques, les convictions religieuses, philosophiques ou de nature similaire, l&#039;appartenance \u00e0 un syndicat, et l&#039;\u00e9tat de votre sant\u00e9 ou votre vie sexuelle<\/h5>\n\n\n\n<p>Je veux dire, le traitement des donn\u00e9es, qui peuvent g\u00e9n\u00e9rer de la discrimination de la personne concern\u00e9e. C&#039;est un objectif qui exige que les exploitants d&#039;aviser l&#039;autorit\u00e9 de protection des donn\u00e9es pour la protection des droits constitutionnels des citoyens, tel que garanti par l&#039;art. 4 (2) de la Constitution.<\/p>\n\n\n\n<p>Cet objectif est destin\u00e9 aux exploitants qui exercent des activit\u00e9s dans le domaine des soins de sant\u00e9, la prestation des services, la tentative de commercialiser le bureau de recensement, les assureurs, les soci\u00e9t\u00e9s dans lesquelles ils ont organis\u00e9 des syndicats, etc.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">2. Le traitement de vos donn\u00e9es personnelles, de la g\u00e9n\u00e9tique et de biom\u00e9trie<\/h5>\n\n\n\n<p>La recherche et le d\u00e9veloppement dans le domaine de la sant\u00e9, \u00e0 des entit\u00e9s autres que les autorit\u00e9s du public qui, de g\u00e9rer et de garder trace de la population, \u00e0 partir de 2015, l&#039;obligation de notification \u00e0 l&#039;autorit\u00e9 nationale de contr\u00f4le, dans la mesure o\u00f9 le traitement de ces donn\u00e9es personnelles.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">3. Toutes les donn\u00e9es \u00e0 caract\u00e8re personnel afin de permettre, directement ou indirectement, de la localisation g\u00e9ographique des individus par des moyens de communication \u00e9lectronique<\/h5>\n\n\n\n<p>Les fournisseurs de services de t\u00e9l\u00e9communications sont les principaux acteurs \u00e9conomiques concern\u00e9s par l&#039;introduction de ce crit\u00e8re. En plus de ce qui pr\u00e9c\u00e8de, il peut \u00e9galement \u00eatre pris en compte, et les fournisseurs de services de taxi services qui utilisent les moyens de l&#039;emplacement des clients pour l&#039;entreprise, dans la mesure o\u00f9, en dehors de la localisation des personnes \u00e0 fournir sont celles de l&#039;ours, et l&#039;identit\u00e9 (nom, nom et toute autre information personnelle qui pourrait mener \u00e0 l&#039;identification).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">4. La commission de l&#039;infraction par la personne concern\u00e9e, ou la condamnation des criminels, des mesures de s\u00e9curit\u00e9, ou des sanctions administratives ou \u00e0 des amendes impos\u00e9es \u00e0 la personne concern\u00e9e, \u00eatre effectu\u00e9e par une entit\u00e9 de droit priv\u00e9<\/h5>\n\n\n\n<p>Centraliser dans une base de donn\u00e9es des personnes qui ont commis des infractions p\u00e9nales et\/ou qui ont \u00e9t\u00e9 condamn\u00e9es ou contre laquelle des mesures ont \u00e9t\u00e9 prises pour la s\u00e9curit\u00e9 ainsi que la d\u00e9tention, la d\u00e9tention provisoire, la d\u00e9tention \u00e0 domicile, ou de mesures, d&#039;amendes, d&#039;ordonnances, de toute personne, peu importe s&#039;ils sont engag\u00e9s dans une activit\u00e9 \u00e9conomique, d&#039;aviser l&#039;autorit\u00e9 de protection des donn\u00e9es.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">5. Le traitement de vos donn\u00e9es personnelles, par des moyens \u00e9lectroniques,<\/h5>\n\n\n\n<p>Il regroupe deux grandes cat\u00e9gories: ceux qui \u00e9mettent des factures \u00e9lectroniques dans le sens d&#039;un nouveau Code des imp\u00f4ts et engag\u00e9es dans le commerce \u00e9lectronique. En principe, toutes les activit\u00e9s sont r\u00e9alis\u00e9es par l&#039;utilisation de moyens \u00e9lectroniques par de l&#039;\u00e9lectronique, de r\u00e9seau, c\u00e2ble, fibre optique, radio, tv, et d&#039;autres, sont utilis\u00e9es pour le traitement, le stockage ou la transmission de l&#039;information, et qui impliquent le traitement de vos donn\u00e9es personnelles, ils exigent que les personnes qui se livrent \u00e0 de telles activit\u00e9s, la notification \u00e0 l&#039;autorit\u00e9 de surveillance.<\/p>\n\n\n\n<p>La plage, les gens, qui ont le statut du contr\u00f4leur des donn\u00e9es personnelles est ainsi \u00e9tendue \u00e0 toutes les entreprises qui g\u00e8rent les magasins en ligne et des plateformes num\u00e9riques, la fin de la politique d&#039;assurance, par voie \u00e9lectronique, \u00e0 l&#039;aide d&#039;outils \u00e9lectroniques de paiement, etc.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">6. Le traitement, avec le but de la surveillance et\/ou de l&#039;\u00e9valuation de certains aspects de votre personnalit\u00e9, ainsi que de la comp\u00e9tence, de cr\u00e9dibilit\u00e9, de comportement, et d&#039;autres<\/h5>\n\n\n\n<p>Le crit\u00e8re de l&#039;objectif, apparemment agences de recrutement de la main-d&#039;oeuvre. Le traitement de vos donn\u00e9es personnelles par voie \u00e9lectronique et dans le cadre des syst\u00e8mes, conduisant \u00e0 l&#039;adoption de d\u00e9cisions automatis\u00e9es en individuel, en conjonction avec l&#039;analyse de la solvabilit\u00e9, de la situation \u00e9conomique et financi\u00e8re, les faits qui sont de nature \u00e0 entra\u00eener la responsabilit\u00e9 disciplinaire, administrative ou p\u00e9nale des personnes physiques, par une entit\u00e9 priv\u00e9e<\/h5>\n\n\n\n<p>In\u00e9vitablement, l&#039;obligation d&#039;informer l&#039;autorit\u00e9 de surveillance doivent \u00eatre conserv\u00e9s dans le responsables des bureaux de cr\u00e9dit et de tous les autres syst\u00e8mes, tels que les bureaux de cr\u00e9dit.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">8. Le traitement des donn\u00e9es \u00e0 caract\u00e8re personnel de l&#039;enfant, r\u00e9alis\u00e9e dans le cadre des activit\u00e9s de marketing direct<\/h5>\n\n\n\n<p>Les deux soci\u00e9t\u00e9s, qui sont la principale activit\u00e9 est la publicit\u00e9 le d\u00e9ploiement de campagnes de marketing et d&#039;autres services de publicit\u00e9, afin d&#039;attirer et de fid\u00e9liser des clients ayant atteint l&#039;\u00e2ge de 18 ans, et les destinataires de ces services, et seulement dans la mesure o\u00f9 les bases de donn\u00e9es sont fournis pour le cas de ce dernier, ou elles seront prises \u00e0 la fin de la campagne publicitaire.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">9. Le traitement des donn\u00e9es personnelles des mineurs est r\u00e9alis\u00e9e par le biais d&#039;internet ou par e-mail<\/h5>\n\n\n\n<p>Les administrateurs de sites web qui n\u00e9cessitent des informations de l&#039;utilisateur afin de d\u00e9terminer l&#039;\u00e2ge et de l&#039;identit\u00e9, ainsi que toutes les personnes qui exercent les activit\u00e9s de l&#039;e-commerce l&#039;un des plus mentionn\u00e9 dans la section 5, et pas seulement, dont les b\u00e9n\u00e9ficiaires sont les personnes qui n&#039;ont pas atteint l&#039;\u00e2ge de 18 ans, et pour lesquelles l&#039;information est le beurre qui est collect\u00e9 pour le traitement de vos donn\u00e9es personnelles.<\/p>\n\n\n\n<p>Les principaux acteurs \u00e9conomiques concern\u00e9s sont ceux qui m\u00e8nent des activit\u00e9s dans le domaine du jeu vid\u00e9o et de films pour les adultes, \u00e0 la fois par les m\u00e9dias en ligne.<\/p>\n\n\n\n<h5 class=\"wp-block-heading translation-block\">10. Le traitement des donn\u00e9es personnelles li\u00e9es \u00e0 l'origine raciale ou ethnique, aux convictions politiques, religieuses, philosophiques ou similaires, \u00e0 l'appartenance syndicale, ainsi que les donn\u00e9es relatives \u00e0 l'\u00e9tat de sant\u00e9 et \u00e0 la vie sexuelle de ses propres membres, effectu\u00e9 par des associations, des fondations ou toute autre organisation sans finalit\u00e9 patrimoniale exclusivement afin de r\u00e9aliser les sp\u00e9cificit\u00e9s de l'activit\u00e9 de l'organisation, <strong>dans la mesure o\u00f9 les donn\u00e9es sont divulgu\u00e9es \u00e0 des tiers sans le consentement de la personne concern\u00e9e<\/strong><\/h5>\n\n\n\n<p>Cet objectif est en vue, associations, fondations, syndicats, associations d&#039;employeurs et d&#039;autres organisations, et seulement dans la mesure o\u00f9 ils sont mis \u00e0 la disposition de l&#039;information mentionn\u00e9e ci-dessus \u00e0 des tiers sans le consentement expr\u00e8s de la personne concern\u00e9e. Le consentement des personnes concern\u00e9es ne sont pas r\u00e9put\u00e9s pour \u00eatre valide, obtenu aussi longtemps que la personne concern\u00e9e n&#039;est pas pr\u00e9vu \u00e0 l&#039;avance, avec des informations telles que:<\/p>\n\n\n\n<p>(i) les donn\u00e9es personnelles sont transmises \u00e0 l&#039;efficacit\u00e9 de<\/p>\n\n\n\n<p>(ii) l&#039;identit\u00e9 du tiers \u00e0 qui vous envoyez vos donn\u00e9es<\/p>\n\n\n\n<p>(iii) de la cat\u00e9gorie de participants dans le cadre du tiers auxquels les donn\u00e9es sont transmises,<\/p>\n\n\n\n<p>(iv) les modalit\u00e9s concr\u00e8tes de l&#039;exercice du droit d&#039;acc\u00e8s, d&#039;un droit d&#039;opposition et \u00e0 l&#039;\u00e9gard des tiers et organisations sont en train de fournir.<\/p>\n\n\n\n<p>Si le consentement de la personne concern\u00e9e est obtenue par la r\u00e9alisation des conditions cumulatives sont sp\u00e9cifi\u00e9s, la notification \u00e0 l&#039;autorit\u00e9 de surveillance concernant le traitement de vos donn\u00e9es personnelles n&#039;est plus n\u00e9cessaire d&#039;\u00eatre effectu\u00e9es par ces entit\u00e9s, cependant, il est possible que l&#039;obligation de notification \u00e0 remplir votre grossesse pour les tiers qui re\u00e7oivent les donn\u00e9es.<\/p>\n\n\n\n<p class=\" translation-block\">Lorsque la loi oblige certaines entit\u00e9s \u00e0 traiter les donn\u00e9es personnelles d\u00e9taill\u00e9es ci-dessus, <strong>la notification \u00e0 l'ANSPDCP n'est plus obligatoire<\/strong>.<\/p>\n\n\n\n<p>Cependant, quel que soit le traitement de vos donn\u00e9es personnelles, effectu\u00e9s, ou la base sur laquelle les donn\u00e9es sont collect\u00e9es et trait\u00e9es et la notification \u00e0 l&#039;autorit\u00e9 de surveillance existe dans tous les cas o\u00f9 les donn\u00e9es personnelles sont transf\u00e9r\u00e9es vers des pays hors de l&#039;Union Europ\u00e9enne, de l&#039;espace \u00c9conomique Europ\u00e9en, ainsi que pour les \u00e9tats membres pour lesquels la Commission Europ\u00e9enne ne les reconna\u00eet pas, par la d\u00e9cision d&#039;un niveau de protection ad\u00e9quat.<\/p>\n\n\n\n<p>Avant la publication de la D\u00e9cision no. 200\/2015 par le pr\u00e9sident de l&#039;autorit\u00e9 nationale de contr\u00f4le, le traitement des donn\u00e9es personnelles, les cat\u00e9gories ci-dessous, nous accordons les op\u00e9rateurs de l&#039;obligation de notifier \u00e0 l&#039;autorit\u00e9 de surveillance les conditions suivantes:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>lorsque le traitement des donn\u00e9es \u00e0 caract\u00e8re personnel relatives aux plaignants, il a \u00e9t\u00e9 effectu\u00e9 par les autorit\u00e9s et les institutions de l&#039;\u00e9tat et les collectivit\u00e9s locales, la d\u00e9centralisation des services publics, des minist\u00e8res et autres organes centraux, les entreprises nationales et les soci\u00e9t\u00e9s, de soci\u00e9t\u00e9s de n\u00e9goce pour l&#039;int\u00e9r\u00eat de la comt\u00e9 ou au niveau local, et les entreprises appartenant \u00e0 l&#039;\u00e9tat, afin de r\u00e9pondre aux exigences de la loi;<\/li>\n\n\n\n<li>lorsque le traitement des donn\u00e9es \u00e0 caract\u00e8re personnel en se r\u00e9f\u00e9rant \u00e0 leurs propres employ\u00e9s, et de collaborateurs externes, et elle a \u00e9t\u00e9 r\u00e9alis\u00e9e par les entit\u00e9s de droit public et de droit priv\u00e9, afin de r\u00e9pondre aux exigences de la loi;<\/li>\n\n\n\n<li>lorsque le traitement des donn\u00e9es personnelles est li\u00e9e aux propri\u00e9taires ou aux locataires d&#039;un immeuble utilis\u00e9 en commun, et il est constitu\u00e9 d&#039;associations de propri\u00e9taires ou de la locataire \u00e0 la jouissance des droits et obligations pr\u00e9vus par la loi, pour les fins de l&#039;administration de la propri\u00e9t\u00e9;<\/li>\n\n\n\n<li>lorsque le traitement est le seul objet la tenue d&#039;un registre pr\u00e9vu par la loi, d&#039;informer le public et ouvert \u00e0 la consultation du public ou de toute personne qui tente de sortir d&#039;un int\u00e9r\u00eat l\u00e9gitime, \u00e0 condition que le traitement est limit\u00e9 aux donn\u00e9es strictement n\u00e9cessaires \u00e0 la tenue du registre, a d\u00e9clar\u00e9.<\/li>\n<\/ol>\n\n\n\n<p><\/p>\n\n\n\n<p>La m\u00eame loi a \u00e9galement abrog\u00e9 la proc\u00e9dure de notification simplifi\u00e9e pour le traitement de vos donn\u00e9es personnelles.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>","protected":false},"excerpt":{"rendered":"<p>Regulile aplicabile p\u00e2n\u0103 la 28 decembrie 2015 pentru&nbsp;colectarea \u0219i prelucrarea datelor personale&nbsp;nu&nbsp;mai sunt valabile \u00een 2016 Regula era ca prelucrarea&nbsp;datelor personale s\u0103 atrag\u0103 obliga\u021bia operatorului de notificare a Autorit\u0103\u021bii Na\u021bionale de Supraveghere a Prelucr\u0103rii Datelor cu Caracter Personal (ANSPDCP).
